After same-sex marriage has gained momentum over recent weeks following its introduction in Iowa and Vermont, the High Court of California has stated that it will rule on Tuesday as to whether same-sex marriages will be permitted in the state.
The high court has previously ruled same-sex marriage as legal, but the issue was brought back to the court’s attention following Proposition 8 passing in November. Legislation that passed following the proposition stated that a marriage in California was only recognized as one being between a man and a woman.
Almost eighty percent of the Californian population voted in November on the proposition, with less than six hundred thousand votes being the difference between ‘yes’ and ‘no’. Over three hundred and forty votes were either blank or or invalid.
Although the Californian High Court has previously stated that a ban on gay marriage is unconstitutional, an overturning of the Proposition 8 vote may be unlikely, due to hesitance of overturning publicly voted legislation.

Could someone please tell me? When in the past has a 52% vote been able to either annul a legal marriage or to determine who is eligible to marry in the future?
